1. Introduction: This Money Back Guarantee (“Guarantee”) is provided to participants (“Participants”) enrolling in the Real Estate Mentorship program (“Program”) conducted by Rohit Gaikwad (“Coach”). The Guarantee is designed to ensure trust and confidence in the Program, while also protecting the interests of the Coach.

2. Participant Obligations: Participants must meet the following criteria to be eligible for the Guarantee:
a. Enroll in the Program by paying the full program fee of INR 50,000 + GST.
b. Attend all scheduled sessions of the Program on time without absence or delay;
c. Complete all tasks and assignments provided by the Coach during the Program and submit it within the specified deadlines;
d. Diligently make efforts to achieve the mutually agreed-upon result, which is the successful closure of at least one real estate property deal (“Desired Result”).
e.Demonstrate active participation and engagement in the Program activities;
f.Maintain a positive and cooperative attitude towards the Coach, fellow participants, and Program content;
G. Abide by all Program rules, guidelines, and codes of conduct as provided by the Coach
h. Refrain from engaging in any behaviour that may disrupt or detract from the learning experience of other participants.
i. Utilise the resources and guidance provided by the Coach to the fullest extent.

3. Desired Result: The Desired Result, as mentioned in Section 2(d), constitutes the successful closure of at least one real estate property deal. Participants must actively engage in the Program and utilise the knowledge and skills imparted by the Coach to achieve this result.

4. Money Back Conditions
a. The Guarantee shall only be applicable if a Participant fails to achieve the Desired Result despite fulfilling all eligibility criteria outlined in Section 2.
b. Failure to attend all scheduled sessions, complete assigned tasks and assignments, or demonstrate reasonable efforts to achieve the Desired Result will void the Guarantee.
c. The Coach reserves the right to assess the Participant’s level of engagement and effort throughout the Program to determine eligibility for the Guarantee.

5. Evaluation Process
a. In the event of a Participant’s failure to achieve the Desired Result, the Participant must submit a written claim for the refund within 3 days of the conclusion of the Program.
b. The claim must include detailed documentation of the Participant’s attendance, completion of tasks and assignments, and efforts made to achieve the Desired Result.
c. The Coach will review the claim and may request additional information or evidence to validate the claim.

6. Coach’s Discretion: The Coach reserves the right to deny a refund request if, in their sole discretion, they determine that the Participant has not met the eligibility criteria outlined in Sections 2 and 3. The Coach’s decision shall be final and binding.

7. Refund Process
a. If the Coach determines that a Participant is eligible for the Guarantee, the Coach shall refund the balance fee amount after deductions like Real Estate Success Box, taxes, Infra and admin charges, food cost, lead generation or service cost etc. to the Participant within the next 90 working days of receiving the claim.
b. The refund shall be processed through the same payment method used by the Participant for enrolling in the Program.

8. Exclusions
a. The Guarantee shall not apply to Participants who breach the terms and conditions of the Program or engage in fraudulent activities to claim the refund.
b. The Guarantee does not cover any incidental or consequential damages arising from the Participant’s participation in the Program.

9. Governing Law and Jurisdiction: This Guarantee shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with this Guarantee shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra.

10. Entire Agreement: This Guarantee constitutes the entire agreement between the Coach and the Participants regarding the subject matter herein and supersedes all prior agreements and understandings, whether written or oral. If any provision of this Guarantee is found to be invalid or unenforceable, such provision shall be severed from the Guarantee, and the remaining provisions shall remain in full force and effect. By enrolling in the Real Estate Mentorship Program, Participants acknowledge that they have read, understood, and agreed to abide by the terms and conditions of this Money Back Guarantee.
